Erfahrungen mit Euroship Services und Kees Cornelissen Shipyards beim Bootbau eines Luxe Motor in Heerewaarden

July 28, 2021. The court verdict was pronounced. 

1. Kees Cornelissen resp. his shipyard has to reimburse us the exchange of the engines incl. the work. 

2. Kees Cornelissen resp. his shipyard has no claim for payment for extra work, because Cornelissen can neither present an execution of extra work nor an order for it.

3. Kees Cornelissen resp. his shipyard has to cancel the entry in the Dutch Ship Register in his name with  immediate effect. 

4. Kees Cornelissen resp. his other shipyard have to cancel the seizure on our boat with immediate effect.

5. Kees Cornelissen resp. his shipyards have to pay the court costs for these judgments.


So far so good. Actually very good. But. . . .

Cornelissen refuses to pay out the amount held in a lawyer's blocked account on the grounds that his one company Euroship Services has outstanding invoices against his other company International Yachtbuilders and Euroship Services therefore has a right to this blocked account.

But this is not enough. Kees Cornelissen has appealed the verdict.

Do we need to understand this? Cornelissen wants from us 499'953.92 plus interest in the amount of 173'163.00 as well for damages for the "harassing" seizure of the money HE does not release now?

Anyway. For better or worse, we will have to go to court with Mr. Cornelissen about the value added tax that he did not deliver correctly when he sold our Adnobis.

After all, it would not be a never-ending story if it were to end here now.


Addendum

We have been back in court and we have been proved right again. Cornelissen has to pay the VAT for Adnobis and also the amounts that were already awarded to us by previous instances. 

It worked in our favor that Gert Jongeneel, Cornelissen's second lawyer, no longer works for him either. His new lawyer is young and seems to be the only one who can stand up to Cornelissen and has common sense. So not only did we get justice from the court, we also got the money we were owed from Cornelissen.

All's well that ends well - or . . the boat that was built twice.
